Please read these Terms and Conditions carefully before using the Cemetery QR "App" operated by us.

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

1. USAGE

1.1. The App is designed to provide information about deceased individuals by scanning the QR code present on the cemetery. It is not meant to replace any official documentation or historical records.

2. PRIVACY

2.1. The App respects the privacy of the individuals represented and their families. Any personal data shared by the users will be handled strictly in accordance with our Privacy Policy.

3. INTELLECTUAL PROPERTY

3.1. All content present on the App is the exclusive property of NRG SURVEY, including, but not limited to, text, graphics, logos, images, and software.

4. USER CONDUCT

4.1. Users are expected to use the App in a respectful manner. Any misuse, including the spreading of false information, defamatory comments, or any other form of disrespect will not be tolerated and may result in permanent ban from using the App.

5. DISCLAIMERS

5.1. While we strive to provide accurate and up to date information, we do not guarantee that the information provided through the QR code is 100% accurate or complete. Users are advised to verify information from other sources as well.

6. LIMITATION OF LIABILITY

6.1. In no event shall NRG SURVEY, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorised access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

7. CHANGES

7.1. We reserve the right to modify or replace these Terms at any time. We will try to provide at least 30 days' notice prior to any new terms taking effect.

9. SUBSCRIPTION PLAN'S PAYMENT

9.1. All payments made in the course of your use of the Services are made using Apple App Store. In using the Application, the Services, or when making any payment in relation to your use of the Services, you warrant that you have read, understood, and agree to be bound by the Apple App Store terms and conditions which are available on their website.

You acknowledge and agree that where a request for the payment of the Subscription Fee is returned or denied, for whatever reason, by your financial institution or is unpaid by you for any other reason, then you are liable for any costs, including banking fees and charges, associated with the Subscriptions Fee. You agree and acknowledge that SURVEY PTY LTD can vary the Subscription Fee at any time and that the varied Subscription Fee will come into effect following the conclusion of the existing Subscription Period. It will be an auto-renewal subscription.
